Welcome to TARGET My Hives, operated by Exco InTouch ("Our Service"). To look after your privacy and to keep the content useful, visitors and account holders must follow the rules in this Terms of Use Agreement ("Terms of Use") and our Privacy Statement. By using Our Service, either as a visitor or an account holder, you are deemed to have accepted these Terms of Use and our Privacy Statement.

1. About us

Exco InTouch is a private company that transforms individual health experiences into support, insight and understanding for others. We do this by enabling people to share personal health experiences and information. In turn this provides support, aids self-management, improves interactions with professionals, with the aim of improving day-to-day health and well-being.

TARGET My Hives is owned and operated by Exco InTouch Limited registered in England and Wales under company number 5285980. Its registered office address is: Unit 6, Wheatcroft Business Park, Landmere Lane, Nottingham NG12 4DG, United Kingdom. Exco InTouch Limited is registered with the Information Commissioner’s Office under the Data Protection Act 1998 under registration number Z9648865.

2. Use of Our Service

Your access to and use of Our Service and of any information contained within it is subject to the Terms of Use and our Community Guidelines. By accessing and using Our Service, you accept, without limitation or qualification, the Terms of Use. We reserve the right to change the Terms of Use from time to time without notice, as we deem necessary. We encourage you to review the Terms of Use periodically to check you understand the latest version. Continued use of Our Service is deemed to be your acceptance of any changes to the Terms of Use and if you are not happy with our amended Terms of Use you should stop using the site. Individuals under the age of 18 are prohibited from creating an account and becoming a member of TARGET My Hives. In registering as a member you are acknowledging that you are aged 18 or above.

3. Medical advice

Our Service’s content, or any content on other sites linked to from Our Service, is never a substitute for professional medical advice. Even if another user appears to be a medical professional they are not in a position to undertake a physical examination or understand your full medical history. Therefore you should always speak to a doctor or other health practitioner about your condition and/or treatment or changes to your condition and/or treatment. In an emergency dial your local or national emergency telephone number. Never delay seeking advice or dialling emergency services because of something that you have read on Our Service.

4. Privacy statement

If you use Our Service it is likely that this will involve sharing information about your health experiences. We recommend using anonymous, unique usernames although it’s important to understand that any information or experiences you share can carry the risk of revealing your identity to others. It is important that you understand how our data sharing relationships work and what information is shared with our different partners and users. As a user of Our Service you can choose at any time whether their healthcare experiences are shared or not shared with the TARGET My Hives community in the "Social Settings" area of the app.

5. Non-commercial use by users

Our Service is for the use of individuals for non-commercial purposes only. To use information gathered from TARGET My Hives commercially or to reach TARGET My Hives users with commercial interest unless expressly authorised by Exco InTouch Limited is against these terms.

If you wish to use Our Service for commercial purposes related to your role within healthcare provision you may be able to extend your account to include a role (e.g. Health Care Professional (HCP), Patient Organisation, Researcher, Provider, etc). In doing so, you will have to comply with Terms of Engagement for Affiliates or HCPs.

6. Acceptable use

You may only use Our Service in accordance with these Terms of Use, our Community Guidelines and, in any event, for lawful purposes in compliance with all applicable laws, regulations and codes of practice in the UK or in any other jurisdiction from where you access Our Service. In particular, you agree not to access without authority, interfere with, damage or disrupt:

• any part of Our Service;
• any equipment or network on which Our Service is stored;
• any software used in the provision of Our Service; or
• any equipment or network or software owned or used by any third party.

You may not obtain or attempt to obtain any materials or information from Our Service through any means not intentionally made available to you through Our Service.

Your contributions must:

• be accurate (where they state facts);
• be genuinely held (where they state opinions); and
• comply with applicable law in the UK and in any country from which they are posted.

Contributions must not:

• contain any material that is obscene, offensive, hateful, inflammatory or defamatory of any person;
• promote any discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
• infringe any copyright, database right, trade mark or any other right of any other person;
• be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety;
• be likely to harass, upset, embarrass alarm or annoy any other person;
• be used to impersonate any person, or to misrepresent your identity or affiliation with any person;
• give the impression that they emanate from us, if this is not the case; or
• advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.

In Our Service, any content that is flagged or reported as abusing our Community Guidelines is sent to the moderators of the community. Community moderators can ban or restrict the user. They can also decide that the user or content in question is not objectionable and no action is required. However, if issues are brought to our attention, we will determine whether there has been a breach of the Terms of Use and what the appropriate course of action is. When a breach of these Terms of Use has occurred or inappropriate material has been posted, we may take such action as we deem appropriate, including, for example, withdrawing your right to use Our Service; removing any posting or material you have uploaded to Our Service; taking legal action against you; or disclosing such information to law enforcement authorities as we reasonably feel is necessary.

The TARGET My Hives Community is associated with health organisations and other approved affiliates and may contain material which is the intellectual property of that affiliate or individual community users. Although the affiliates may provide material and take an active role within the community, nothing in these Terms imposes an obligation to the affiliates or individuals.

7. Registration

You will not be able to use Our Service properly unless you register with us. By registering and becoming an account holder, you agree that we may provide you with information about Our Service (whether by email or any other medium) that we consider appropriate. You may opt-out of receiving these communications using the unsubscribe links provided in the communication materials.

When you register initially you will have access to a patient account. If you subsequently wish to have an account type which represents your role within healthcare provision (e.g. medical professional, researcher, community admin) which enables access to additional services provided by Exco InTouch, your use of the new account type and additional services may be subject to additional terms and conditions which will be made available to you as part of the extension process.

In order to register with us and become an account holder, you will be invited to provide a password, a user name and an email. You are entirely responsible for maintaining the confidentiality of your password and account. You will never be required to reveal your full password to any representative or agent of Exco InTouch. If you forget your password, we may ask you to answer a specific question such as your username, date of birth or postcode. Furthermore, you are entirely responsible for any and all activities that occur under your account.

You agree to notify target@excointouch.com immediately of any unauthorised use of your account or any other breach of security. We will not be liable for any loss or damage that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for loss or damage incurred by us or another party due to someone else using your account or password. You may not use anyone else’s account at any time, without the express permission of the account holder. If you think that someone else has access to your password you should change it immediately.

8. Indemnification

You agree to indemnify, keep indemnified defend and hold harmless Exco InTouch Limited, its officers, directors, employees, agents, suppliers and third party partners from and against all liabilities, losses, expenses, damages and costs, including reasonable legal fees, claims, demands and proceedings whatsoever, howsoever arising, resulting from or in connection with any violation by you of these Terms of Use, including, without limitation, the submission of any inaccurate or incorrect information. Exco InTouch can provide no assurances, warranties or guarantees as to the accuracy or completeness of the information provided directly or indirectly in Our Service and shall not be liable for any losses, damage or distress incurred as a consequence of you using Our Service as explained in section 12 below.

9. Third parties and third party websites and links

We also may provide links or references on Our Service to the websites of other companies, charities or other organisations and individuals whether affiliated with us or not. By clicking on these links and accessing these other websites, you will be leaving Our Service. Some of these links are added by users and we are not in a position to verify every link posted on Our Service.

Similarly, Our Service may be accessed through third party links over which we have no control. We make no warranties or representations of any kind as to the accuracy, currency, or completeness of any information contained in such websites and shall have no liability for any damages or injuries of any kind arising from such content or information. Inclusion of any third party link does not imply an endorsement or recommendation by Exco InTouch Limited.

You may link to Our Service, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

10. Proprietary rights

The entire contents of Our Service are protected by copyright, database rights and other intellectual property rights which are owned by us or our affiliates including health organisations and individuals. The contents of Our Service may not be copied, displayed, downloaded, distributed or republished other than for non-commercial individual reference with all copyright or other proprietary notices retained, and thereafter may not be recopied, reproduced or otherwise redistributed. Nothing contained herein shall be construed as conferring by implication, estoppels or otherwise any licence or right under any patent or trademark of Exco InTouch Limited, or any third party.

11. Written communication and notices

When using Our Service, you accept that communication with us will be mainly in electronic format. We will contact you by email or provide you with information by posting notices on Our Service. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

All notices given by you to us, including any complaints that you might have about Our Service, must be given to Exco InTouch Limited at Unit 6, Wheatcroft Business Park, Landmere Lane, Nottingham NG12 4DG, United Kingdom or by email to target@excointouch.com. We may give notice to you at the email address you provide to us when you become an account holder.

12. Content and Limitation of Liability

TARGET My Hives is a technology platform. All views, opinions, and knowledge expressed on the service by account holders or visitors are the sole opinions of the account holders or visitors themselves and are likely to relate to their own specific circumstances which may be different to yours. The owners of Exco InTouch Limited and the affiliates we work with make no warranties or representations of any kind as to the accuracy, currency, completeness, reliability, operability, or legality of information or opinions contained or expressed within Our Service. Commentary and other materials posted on Our Service are not intended to amount to advice on which reliance should be placed. We and the affiliates therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to Our Service, by any account holders, or by anyone who may be informed of any of its contents.

Further, Our Service is provided to you free of charge on an "as is" and "as available" basis. You agree that access to and use of Our Service and the content available on Our Service is at your own risk. To the fullest extent permitted by law, Our Service and any individual person connected to Our Service and any party involved in creating, producing or delivering Our Service hereby exclude:

• All conditions, warranties and other terms that might otherwise be implied by statute, common law or the law of equity; and

If we fail, at any time during the term of your use of Our Service, to insist upon strict performance of any of your obligations under these terms of use, or if we fail to exercise any of the rights or remedies to which we are entitled under these terms of use, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.

No waiver by us of any of these terms and conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing in accordance with the methods specified above.

15. Severability

If any of these terms and conditions or any provisions of these terms and conditions are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions, which will continue to be valid to the fullest extent permitted by law.

16. Fees

Access to and use of this Service are currently available without charge. We reserve the right to charge a fee for access to or use of this Service in the future. You will be given prior notice in the event we find it necessary to charge a fee for use of this Service and if you do not wish to pay such fee you will be able to end your use of the Service.

17. Entire agreement

These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to access to and your use of Our Service and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

19. Law and jurisdiction

These terms and conditions and the agreement between you and us will be governed by English Law. Any dispute arising from, or related to, these terms and conditions or our agreement shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

Community Guidelines

As a member of the TARGET My Hives community you are expected to follow a few basic guidelines to ensure that every user feels safe and comfortable engaging with others in the community.

Professional Health Information

Information posted on TARGET My Hives can support, but will not replace the relationship between you and your doctor or any other healthcare professionals. Information from this service may inform your discussions as well as the exploration of treatment options with your healthcare professionals. You should always consult a healthcare professional if considering changing your medication or treatment.

Community Atmosphere

Your participation on TARGET My Hives should be with respect, honesty, and in the spirit of supporting and learning from your fellow users.

TARGET My Hives is not a forum to create negative impressions about identifiable individuals. Negative and damaging references to identifiable individuals may be edited or deleted either by TARGET My Hives community administrators. We hope that users will respect the right of other community members to present their individual health experiences, regardless of whether or not they are in agreement, and that all disagreements will be expressed considerately.

Publishing Content (Questions/Posts/Replies/Private Messages)

Anything published on TARGET My Hives should be understood as being the views of that individual and does not necessarily represent the views of a particular patient group or of Exco InTouch Limited as a company.

As a member of the TARGET My Hives community, you agree to publish information that is true and correct to the best of your knowledge and you agree to publish information that is primarily drawn from your expert knowledge or personal experience.

Any content published in TARGET My Hives can be read, used, reproduced, and cited by other members of TARGET My Hives, but you always maintain the option of deleting any content you have submitted at any time.

When you publish information from third party sources, such as information about new treatments, you are asked to provide references and links wherever possible.

If an account is suspected of violating any of these guidelines as stipulated above, particularly in the instance of bullying or spamming, that member's account may be restricted or banned.

Terms of Engagement for Affiliates and HCPs

An affiliate refers to any non-profit health organisation, patient group, individual, hospital, or medical professional with which TARGET My Hives is in partnership and who has agreed to these Terms of Engagement for Affiliates and HCPs. This generally refers to partners who are involved in the TARGET My Hives community.

By being part of the TARGET My Hives community you agree to the following:

1. Exco InTouch Limited provides TARGET My Hives free of charge to health organisations and other affiliates as well as users (community members). Any future standard updates and maintenance of the service will be at the cost of Exco InTouch Limited.
2. Exco InTouch Limited provides support for the platform to health organisations and other affiliates via the TARGET My Hives support team and automatic systems. Premium support as well as extra features and services may be offered separately in the future.
3. TARGET My Hives community members can choose whether or not their healthcare experiences are shared with Research Partners. Healthcare experiences include the posts, comments, questions and answers and indeed any content that users provide that offers insight into living with a particular condition. TARGET My Hives community members can opt out of this in their individual account settings.
4. Exco InTouch Limited will not share personal details, such as email addresses, with or on behalf of other individuals, organisations or research partners without the users’ consent.
5. Exco InTouch will protect users’ personal details using recognised data protection tools and practices (see Privacy Policy).
6. Exco InTouch and health organisations or other affiliates will keep the communities free of commercial intrusion by making sure users do not use posts or questions to advertise their products. Advertising controlled by Exco InTouch may be used in the future across TARGET My Hives
7. There is no direct contractual relationship between the health organisation or other affiliate and any other actual or potential research partner via TARGET My Hives unless specifically arranged.
8. There is no contractual relationship between the TARGET My Hives community and TARGET My Hives research partners. However, if the user, where invited and eligible, contributes to a particular project, then there may be terms and conditions specific to that activity by which the user may be bound.
9. To support TARGET My Hives relationship with its research partners, promotion, research or information gathering on the platform by, or on behalf of, research partners or sponsors of health organisations or other affiliates may be done only with the express, prior consent of Exco InTouch Limited.

We reserve the right to change these Terms from time to time. This may be for reasons including legal or administrative requirements, or to correct an inaccurate statement. We will endeavour to provide notice of the change to community admins where we deem this necessary. We encourage you to review these Terms periodically to check you understand the latest version.

These terms should be read in conjunction with TARGET My Hives general Terms of Use and any person registering on the service will be bound by those standard Terms of Use.

Because this may involve you sharing sensitive information about your health and treatment we also believe in the importance of clear and transparent privacy guidelines. As a user of TARGET My Hives it’s important you know how we use and share your data and how you can control what happens to information you share with TARGET My Hives.

Below is guide to how TARGET My Hives manages your personal information:

1. Sharing and Controlling Information

Who are you?

Who can see my personal identifiable information?

None of your personally identifiable information (i.e. email address, postcode/zipcode, date of birth) is ever visible to other users or third parties without your explicit consent. We encourage you to choose a non-identifiable username as this is visible to other users within the TARGET My Hives community.

Who can see the blogs and questions I write?

When you agree to share your experiences under the “Social Settings” function you are agreeing to the sharing elements of your experiences with the TARGET My Hives community. If there is anything which you are not comfortable sharing with the TARGET My Hives community, you should not include it in your posts, questions, comments, or answers.

Who can see my non-personally identifiable information?

TARGET My Hives may anonymise and aggregate information collected through Our Service (e.g. polls, symptom surveys, etc). This information may then be published as a study or shared with our research partners.

How can I control who sees my information?

You always control who can see your information and how it is shared. At any time you can change your data sharing settings within the “Social Settings” function to stop sharing information you submit. You will still able to use the TARGET My Hives service.

Will I be contacted for research purposes?

We may contact you for research purposes, such as taking part in surveys or clinical trial recruitment. In this case it will always be TARGET My Hives that contacts you, not a research partner directly as we never share your email address with third parties. You can opt out of being contacted for research using the unsubscribe links provided in the communication materials.

2. Who can access information and how

Patient Organisations and other Affiliates

Health organisations and other affiliates of TARGET My Hives can access and export anonymised and aggregated data reports from users within the TARGET My Hives community who have chosen to share their data. An affiliate refers to any non-profit health organisation, patient group, individual, hospital, or medical professional with which TARGET My Hives is in partnership and who has agreed to and filled out the Terms of Engagement for Affiliates and HCPs.

Doctors and other Healthcare Professionals

TARGET My Hives welcomes Healthcare Professionals (HCPs). When Doctors and Healthcare Professionals use TARGET My Hives, information will not be made available to them unless a patient chooses to share this information with them. If patients consent, this information can also be used and aggregated for research and audit by the doctors in their academic studies.

Institutions and Industry

Health Institutions (e.g. NHS or Department of Health) and Companies (Pharmaceuticals or Medical Devices) can use TARGET My Hives to research the experience of patients. This may be analysis of data submitted by users of the TARGET My Hives service, or through more structured studies alongside doctors and patients. This only happens where users give their consent to share information and users can opt out at any time as set out above.

3. Clinical Information

Do you store clinical information?

We offer a system that has an ultra-secure database for clinical data storage (compliant with regulations) and a separate database to allow patients to control their own data. This satisfies the ethical and legal requirements of safety of clinical data whilst providing the flexibility needed to offer secondary data services.

Is TARGET My Hives integrated with hospital systems?

TARGET My Hives is not integrated with any hospital systems and does not directly share your medical information with healthcare professionals. As a user of Our Service, you have the right to share your stored information with you healthcare professional

4. The TARGET My Hives business model

The TARGET My Hives services are free for users and affiliates (e.g. non-profit health organisations). In addition to our licensed software we work with research partners allowing them to access anonymised and aggregated data from TARGET My Hives services.

This only happens where users give their consent to share information and users can opt out at any time as set out above.

5. Privacy and Security

Exco InTouch provides industry standard security across all of the TARGET My Hives Services and complies with health IT standards. In addition, we have secure connections (HTTPS) with 128 bit encryption certificates across all the areas where personal details are used and stored. All passwords assigned during the signup processes are protected using salted cryptographic hashing, and cannot be decrypted.

All user data is hosted in protected environments with secure backups performed regularly and in compliance with ISO 27001.

Our service is hosted on third party servers with may be outside the EEA. We have contracts in place with our third party service providers which require them to implement security measures to protect the data they hold and the current security provisions in place are described above.

Does TARGET My Hives use cookies or other tracker technologies?

TARGET My Hives uses cookies to provide basic service functionality and to improve the performance and user experience throughout the service. We may also store encrypted information about you using cookies which we can access when you visit Our Service in the future.

6. Minimum Age Policy

Persons under the age of 18 are prohibited from creating an account and becoming a member of TARGET My Hives. In registering as a member you are acknowledging that you are aged 18 or above. We do not knowingly collect personal information from persons under 18. If we become aware that a person under 18 has provided us with personal information, we take steps to remove such information and will delete the individuals account.

7. Communications with you

By becoming a member of the TARGET My Hives community, you agree that we may provide you with information about Our Service (whether by email or any other medium) that we consider appropriate. You may opt-out of receiving these communications using the unsubscribe links provided in the communication materials.

8. How can I withdraw from the Service and what will happen to my information?

If at any time you wish to stop using Our Service or want to withdraw from Our Service, you can do this from within the “Personal Information” section of the TARGET My Hives app by choosing the “delete my account” option. This will delete all references to you on the servers and withdraw you from the TARGET My Hives service. You have the right to re-join Our Service at any time, however, if your account has been deleted we will not be able to resurrect any historical data.

9. If you need more information

How do I make a subject access request?

All the information we hold about you is available to you when using Our Service and is contained within your TARGET My Hives app. In order to provide the service to you, TARGET My Hives keeps a mirror of this data on the servers and as we have explained, you are totally in control of the options around access, availability, communications and content. If you decide that you do not wish TARGET My Hives to continue to hold this information, you should withdraw from the service as detailed in 8 above.

Under the Data Protection Act 1998, you are entitled to request a copy of the information we hold about you if you so wish. Please put your request in writing and send it to TARGET My Hives, Unit 6, Wheatcroft Business Park, Landmere Lane, Nottingham NG12 4DG, United Kingdom. We reserve the right to charge the statutory fee of £10.

• Helping us to develop products and create campaigns that are designed around you, optimise patient services and continuously improve MyHives.com services

We process your personal data only for those purposes that we have communicated with you. If we use it for other (closely related) purposes, additional data protection measures will be implemented if required by law. Exco InTouch who is the provider of MyHives.com is responsible for the storage of the data and By registering your interest in MyHives.com you agree that your personal data will be stored in a secured database by Exco InTouch. You will have the ability to unsubscribe from further updates by following the unsubscribe link in the email communications you have agreed to receive.

Special information for parents

While MyHives.com websites are not generally targeted at children under the age of 16, it is Target-Communitys' policy to comply with the law when it requires parent or guardian permission before children's information is collected, used or disclosed.

MyHives.com strongly recommends that parents take an active role in supervising the online activities of their children. If you believe we have collected personal data from a person who is under the age of 16, please contact us at privacy@excointouch.com

How we protect your Personal Data

We recognise and take seriously our responsibility to protect the personal data you entrust to MyHives.com from loss, misuse or unauthorised access. Target-Community uses a variety of security technologies and organisational procedures to help protect your personal data.
